SEC Investigating Mark Hurd: WSJ

Looking Into Pillow Talk about EDS and Destroying Evidence

The Securities and Exchange Commission is investigating ex-HP CEO Mark Hurd's mysterious, Wall Street-stunning "resignation" from HP, according to the Wall Street Journal.

The paper says that the regulators are looking into the allegation that Hurd told his supposed love interest, former HP contractor Jodie Fisher, about HP's intention to buy EDS for $13.9 billion in 2008.

Fisher made the allegation but it did not surface until relatively recently. Supposedly neither she nor anybody else traded on the information.

After settling sexual harassment charges with Hurd, she also said that some of her initials claims were inaccurate but never explained which ones.

Although the probe may never come to anything, the Journal says that the SEC is also investigating the allegedly inaccurate expense reports on which the company publicly seemed to hang Hurd's termination and whether Hurd "destroyed computer evidence related to his August departure," a wholly new allegation.

The Journal didn't explain how it knew and said it didn't know how far the investigation had progressed, but that Hurd, now co-president of Oracle, has hired Daniel Bookin of O'Melveny and Meyers, who handles white-collar criminal cases and civil securities suits.

HP is reportedly co-operating with the investigation.
